These Terms of Service govern your use of versifa.com and purchases from Versifa. The website and store are operated by 11675 Sands Ave LLC ("Versifa," "we," "us," or "our"). By accessing the website or placing an order, you agree to these Terms.

1. Eligibility and acceptable use

You must be legally capable of entering into a binding agreement in your jurisdiction. You may use the website only for lawful personal or business purposes. You must not misuse the website, interfere with its security, introduce malicious code, scrape or access it in an unauthorized manner, impersonate another person, or use it to violate any law or third-party right.

2. Product information

We make reasonable efforts to present product descriptions, colors, dimensions, materials, compatibility, and images accurately. Screens and lighting may affect how colors appear. Only features expressly stated on a product page are included. In particular, do not assume a watch is water-resistant, waterproof, or suitable for a specific activity unless that capability is expressly stated.

3. Prices, taxes, and payment

Prices are displayed in U.S. dollars unless stated otherwise. Applicable taxes, shipping charges, and discounts are shown at checkout. Payment must be authorized before an order is accepted. Payment services may be provided by Shopify Payments or other displayed providers, subject to their security and verification procedures.

4. Orders

An order confirmation acknowledges receipt of your order but does not guarantee acceptance. We may decline or cancel an order for suspected fraud, payment failure, pricing or inventory error, unlawful activity, shipping restrictions, or other legitimate business reasons. If we cancel a paid order, we will refund the canceled amount to the original payment method.

5. Shipping and fulfillment

Shipping methods, fees, estimated delivery windows, tracking, address responsibilities, and third-party fulfillment disclosures are described in our Shipping Policy, which forms part of these Terms. Delivery estimates are not guarantees.

6. Returns, refunds, and cancellations

Returns, refunds, exchanges, damaged items, and cancellation requests are governed by our Return and Refund Policy, which forms part of these Terms. Nothing in these Terms limits non-waivable consumer rights.

7. Promotions and discounts

Promotions may be subject to separate eligibility rules, dates, minimum purchase amounts, exclusions, and usage limits. Unless expressly allowed, discounts cannot be combined, transferred, redeemed for cash, or applied retroactively.

The Versifa name, branding, photographs, graphics, text, page design, and other website content are owned by or licensed to us and are protected by applicable intellectual property laws. You may view the website for personal shopping purposes, but you may not reproduce, distribute, sell, modify, or commercially exploit our content without written permission.

9. Reviews and submitted content

If you submit a review, image, comment, or other content, you confirm that it is accurate, lawful, and does not infringe another person's rights. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with operating and promoting Versifa. We may remove content that violates these Terms.

The store is hosted by Shopify and may rely on third-party payment, analytics, shipping, fulfillment, customer service, and marketing providers. Third-party sites and services are governed by their own terms and privacy practices. We are not responsible for independent third-party content or services outside our reasonable control.

Our collection and use of personal information are described in our Privacy Policy. By using the website, you acknowledge those practices.

12. Disclaimer

To the fullest extent permitted by law, the website and its content are provided on an "as available" basis. We do not promise that access will always be uninterrupted, error-free, or secure. Product warranties, if any, are limited to those expressly stated in writing. These limitations do not exclude warranties or rights that cannot legally be excluded.

13. Limitation of liability

To the fullest extent permitted by law, Versifa and 11675 Sands Ave LLC will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or products. Our total liability for a claim relating to an order will not exceed the amount paid for the affected product, except where applicable law does not allow that limitation.

You agree to be responsible for losses and reasonable costs resulting from your unlawful misuse of the website, violation of these Terms, or infringement of another person's rights, to the extent permitted by law.
